THE ESSENTIAL GUIDE TO YOUR MEMBERSHIP

Before you Start!

All customers using the gym or undertaking an exercise programme are required to complete a Physical Activity Readiness Questionnaire (PAR-Q). If advised by our fitness team, it is your responsibility to secure the approval or seek the advice of your GP before commencing an exercise programme.

Membership Cards

All customers are required to present their membership card on each visit to the facility. In the event that you lose your card, a replacement will be made available at a nominal charge. The card may only be used by the named cardholder and in accordance with our terms and conditions.

Clothing

Working out is NOT about how you look! However, please wear suitable footwear and comfortable exercise clothing in all appropriate areas. Swimwear should be worn at all times in our Sauna, Steam and Spa areas.

We recommend that you bring 2 towels with you – a workout towel whilst your using the facilities and a fresh one for your shower afterwards – working out can be a particularly sweaty business!

Lockers

Lockers are provided for the security of your belongings. Please use them and help us keep our activity areas tidy by not bringing kit bags, coats and the kitchen sink into the gym and group exercise rooms! Lockers operate on a coin returnable basis.

Using the Gym

To get the very best from your session in the gym, collect the programme that you have discussed with the instructor. Remember it is vital that you vary your workouts. See an instructor for an experience session or improvement plan.

Drink copious amounts of water during exercise as it re-hydrates the body and will enable you to get more out of your workout.

PROGRAMMED & BOOKABLE ACTIVITIES

Classes, Personal Training, Courts, Crèche etc.

These activities are bookable in advance. Members may book up to 28 days in advance and pay for the activity (unless the activity is included within the Membership fee) at the time of taking up the activity. You may also book any number of activities at one time.

Cancellations

Members who cancel a booking that is subsequently re-let will not be charged for the cancellation. Bookings that cannot be re-let will be charged at the Standard rate (even if the activity is included within the Membership fee).

Should we be unable to fulfil your appointment we will make every effort to give you at least 24 hours notice, reschedule your session and offer you an alternative session free of charge.

Young People

Junior members (11–16 yrs) are permitted to use the gym at Off-Peak times under the supervision of a parent or adult aged 18 or over. Unaccompanied use of the gym for Junior members (11–16 yrs) is restricted to programmed sessions under the supervision of a gym instructor.

Respect for Yourself and Others

Shaving is not permitted within the facility.

Whilst keeping in touch with friends and family and conducting business is to be applauded, doing so by mobile phone whilst exercising may be both dangerous to you and annoying to others, and should please be avoided!

Please let us know immediately of any damage or fault to equipment or fixtures.

Photography

The use of photographic or video equipment is not permitted within the facility unless a permit has been provided. Please contact Reception for details.

Change of Details

Should your personal details change, please notify us immediately. As a valued member we would like to ensure you get all the benefits to which you are entitled, so please let us know if you change your name, address, telephone numbers or e mail address and we will amend our records accordingly.

MEMBERSHIP DEFINITIONS

Family Add-On

An additional ‘family’ member may be added to certain membership categories and qualify for a reduced fee – this enables partners to join the facilities together. In such cases, the additional member must reside at the same address as the ‘head’ member and the fees must be collected from one account.

Corporate

We encourage memberships from bona-fide organisations. Corporate memberships are restricted to the ‘Fitness Plus’ category only.

Students

Memberships are offered in some circumstances to Students. Student members must be over the age of 16 and in Full Time Education.

Senior Citizens

Memberships are offered in some circumstances to Senior Citizens. Senior members must be over the age of 60.

Off–Peak

Some use of facilities within a membership is restricted to Off-Peak times. These times are published locally and are subject to variation.

Availability

Some categories of membership may not be available at all facilities.

TERMS & CONDITIONS OF MEMBERSHIP

Membership Agreement

The decision to enter into this agreement remains at the sole discretion of Active Nation, who reserve the right to verify or require proof of all information provided by the customer. Should the customer provide any fraudulent or wrongful information, Active Nation reserve the right to terminate the agreement.

Membership commences upon the receipt of the Start Up Fee and on the date of this agreement.

This agreement shall be considered legally binding between Active Nation and the customer.

Marketing & Data Protection

The provision of the customer’s details implies acceptance of the terms of the Data Protection Act.

The customer agrees for their details to be used for marketing purposes during and beyond the end of this agreement unless they request otherwise.

Your Health

The customer warrants that they are in good health and knows of no reason why they should not safely participate in exercise.

Money Back Guarantee

A 10 day Money Back Guarantee is offered to all new members. All monies paid in respect to membership will be refunded in full should you, for whatever reason, wish to terminate this agreement within 10 days of joining.

Fees & Charges

Start Up Fees are payable at the point of joining and cover our reasonable administration costs.

Pro-Rata Payment is the amount required to cover the period from the day of joining to the date of the first direct debit collection.

Direct Debit payments are payable in advance on the first day of each month.

In order to qualify for certain membership options you are required to provide evidence of eligibility. Should this evidence not be forthcoming you will be required to pay the standard rate.

You are required to nominate a credit or debit card as an alternative method of payment which you agree we may use should the primary payment method fail for any reason. Your signature on the credit or debit card mandate will authorise us to debit the account with the total amount due without notice to you.

Membership Holidays – ‘Freezing Your Membership’

As a benefit to a direct debit membership, we offer the opportunity to temporarily suspend or ‘freeze’ your membership in the event of prolonged absence such as extended holiday, working away or serious illness or injury. This benefit is available for a minimum of 1 month up to a maximum of 3 months, and carries a reduced fee of £5 per person per month.

To activate this benefit, please contact a Customer Advisor.

Please note, at the end of the ‘frozen period’ your monthly direct debit will revert to its original fee.

Refunds & Transfers

Membership is non-refundable and non-transferable.

Prices

Prices may be reviewed during the course of any twelve month period and we undertake to provide at least 14 days notice of any price change.

Personal Trainers

Some personal trainers in our facilities operate on a self employed basis. Any service they provide to you constitutes only a contract between you and the trainer. We accept no responsibility for any breach of contract or negligence caused by a personal trainer.

Disruption

It may be necessary to undertake essential maintenance to the facility and it’s equipment at any time.

Every attempt will be made to provide advance notice and to minimise disruption and inconvenience.

We cannot be held responsible for any service or equipment that is unavailable due to breakdown or fault.

We may alter the hours of business, activity programmes and prices and reserve the right to refuse admission.

We reserve the right to offer recompense only in the event of full and prolonged closure at our sole and absolute discretion.

Personal Property, Injury, Illness and Death

We do not accept responsibility for the loss of, or damage to, property on the premises, nor do we accept responsibility for illness, injury or death on the premises, unless caused by our own negligence.

TERMINATION

By the customer As a valued member, you have complete control over your membership with no minimum membership contract.

However, we recognise that many people’s circumstances change. In such an event, should you wish to terminate your membership we ask that you notify us in writing giving 30 days notice.

Upon termination, all membership cards must be returned.

We reserve the right to collect any monies outstanding in the event of this Agreement not being upheld.

By Active Nation

Active Nation reserves the right to terminate this agreement if the customer’s conduct is considered to be injurious to the character, name or interest of the organisation or other customers.

The agreement may also be terminated if there is any breach of a regulation or condition that may exist from time to time or should fees remain unpaid 30 days after the due date.

In the event of termination, the customer will have no entitlement for any refund.

Consumer Rights

The terms of this Agreement do not infringe upon any other right legally enjoyed by the customer under the terms of any consumer legislation or the Direct Debit Guarantee.

Law

Relevant UK law shall apply to this contract and the relevant courts of the UK shall have exclusive jurisdiction to deal with any disputes arising in relation to it.
